Every time I see it, I think about all the problems going unsolved because people are too busy ranting about someone they can't change. <br> <br> Here's the truth: Washington D.C. thrives on your anger gone completely unused, or vented in useless ways like on a Craigslist forum. Doing that makes sure that their power goes unchecked. And they love the attention your shouting at toothless protests gives them; they can smile and wave while not giving two [hoots] about your idea of government. That is, at least not until election time comes around again, when they'll just polish the old list of lies. Every time you spend an hour pouring what's left of your day's energy on watching C-SPAN or FOX or whatever, you feed their enormous egos. By expecting Washington (and Austin - and your city/county offices) to do everything for you, you inflate the system that, again, doesn't have to listen to you if it's not in the mood to do so. <br> <br> Be honest with yourself: don't you feel degraded to depend on someone maybe feeling it in their good graces to bend your way? More than that - we're going to say what the problems are, going to think with our own brains what we think should change, then form our own policies. That's politics, folks: you see a need in your surroundings, you take yourself off that chair and you fill that need you see. If you can't do it now, then you form a plan to do what it takes to meet that need by the end of the year, or the next five years. And you mobilize people. Then I see that people who can't even spell are the ones taking it upon themselves to steer the minds of everyone else. Are these the people I want to help direct matters of great importance to all of us? <br> <br> What saves me from becoming a bitter elitist, then competing for power with the other members of the elite? Those don't have basic writing, reading (and critical thinking) skills - also manage to get into positions of power (or at least land a spot on prime-time television). And they -really- convince me that we should get rid of formal power structures in society. When what a state officials says, goes, no amount of intelligent argument or discussion will matter in the steering of society. But if people are weaned off letting our corporate-bought "representatives" think for us, then maybe, just maybe, people will grow more aware of the big picture, by necessity. It worked in ancient Athens with the democratic councils, in modern Ukraine in the 1910s, Catalonia in the 1930s. <br> <br> And should the "tea party" movement manage, against all odds, to tear down the federal government (you know, except for the border patrol, which they will increase to the point of rivaling the armed forces), here's hoping we'll have something to replace it with, other than the upper management to corporations, who -don't- get elected and answer to the public the way "representatives" do: the least amount possible. If you don't own a car or don't own a house, you don't pay for insurance. However, with the government takeover of health care, you will be required to purchase health insurance. You will not be allowed the ability to make that decision. And your mandated premiums will be adjusted upward in order to compensate for the people who cannot purchase health insurance. If you are deemed capable of paying, and you elect not to, you will be fined or jailed. Is this really the proposition put forth by a free country? <br> <br> But, it's not just healthcare. When the government raises your taxes, you will be forced to comply. When the government forces you to insulate your house based on a code which is designed to further restrict our use of energy, you will not have any choice but to comply. When the government creates laws that inhibit your ability to eat the foods you enjoy, then more of your rights will have been trampled. <br> <br> For those who think I am crying wolf, all of the items I just mentioned are already happening or are in place waiting to be activated. <br> <br> It is my assertion that we need to gather together and take back our country. <br> <br> I think all of the titles and names such as democrat, republican, conservative, liberal, populist, progressive, left or right, have lost their meaning. I am an American. I want my freedom. I want to be allowed to pursue my happiness. Our government does not know best! <br> <br> For all of those who need the government to take care of you, you have my pity. No, I do not feel sorry for you, I pity you. <br> <br> I truly believe you should get out of life exactly what you put in. No more. Given that Democrats announced the day before that they were banning the earmarking of federal dollars to for-profit businesses, the only opportunity for one-ups-manship by Republican's was a complete ban. But the Republicans seem to be hoping that no one will remember how we got into this earmark mess in the first place. Even more, they hope no one will remember what they said about earmarks before they won control of Congress and what they did about them after they were in charge. <br> <br> Lets look back to 1991 when Congress was debating new highway legislation. Republicans were so outraged at the inclusion of 500 earmarked highway project they staged an all night talk-a-thon to deride the legislation. Current Republican Floor Leader John Boehner told the C-Span cameras that night, <br> <br> I have only been here 7 months, but during my years of public service I have seen some pretty outrageous activities occur in legislative bodies. But I have never seen anything as outrageous as the 1991 highway bill.... I stand opposed to this legislation because spreading pork around to secure enough votes to pass this turkey is wrong. <br> <br> Congressman Cass Ballenger promised, "When the Republicans control this body, the American people won't have to wait while we squabble among ourselves over how to make the taxpayer foot the bill for pork..." <br> <br> A year later, soon to be Speaker Newt Gingrich told the House "the Democrats...see no contradiction between adding $1.5 billion in pork barrel for the politicians and voting for a balanced budget." <br> <br> In the years leading up to their seizure of power in 1994 it seemed that Republicans care about eliminating pork more than almost anything. But after the election was a different story. Not only did they not make good on their promise to banish earmarking they literally sent the process through the roof. Government programs that had never previously contained earmarks became saturated with them. Programs containing only a few earmarks became almost nothing but earmarks. The Labor-Health, Human Services and Education bill went from having no earmarks in 1994 to $33 million in earmarks in 1996, nearly a $100 million in 1998, half a billion in 2000 and more than $1 billion in 2002. <br> <br> A report that I prepared along with others on the Appropriations minority staff in the fall of 2003 described how dramatically the practice had careened out of control. It indicated, fore instance that the number of earmarks in Defense Operation and Maintenance account had swelled from 33 before the Republican takeover to 232 by 2004. In Defense Research and Development the number of earmarks grew from 219 to 1299. This was happening in nearly every appropriation bill and it wasn't just happening in Appropriations. <br> <br> The report drew only snickers from Republicans who were committed to conquering new heights in the realm of earmarks. Perhaps the pinnacle was reached with the passage of the 2005 highway bill. Instead of containing 487 earmarks--the number that sparked the all night protest by Republicans on the 1991 highway legislation--the bill contained 6,371 earmarks controlling the expenditure of $23 billion in federal money. As a report I did for the Center for American Progress indicated, the bill not only contained more earmarks than any highway bill in history it contained more than all highway bills combined. <br> <br> President Bush decided to travel to Speaker Dennis Hastert's home state to sign the legislation and congratulate the speaker on a $200 million earmark to build a four lane highway near property the speaker had recently purchased. <br> <br> Since they lost control of Congress, numerous reforms have been adopted. People requesting them have to post their requests and the justification for the request on the internet so the public and the press can find out who wanted them and why. Members must certify that neither they nor their family have a financial interest in the earmark. The number and size of earmarks have been substantially reduced from 2007 levels. Earmarks to for profit companies must be put up for competition by agencies managing the funds if they believe the recipient will not provide the government with best value. Now for profit earmarks are being eliminated altogether. <br> <br> But none of that is enough. The party of "reform" is on the march again. It appears that their commitment right now is only to give up earmarks for this year. Since their Senate counterparts don't expect to allow many if any appropriations pass before the election they probably aren't giving up very much. The question is what will the policy be for 2012 when if all goes as planned they will be back in the drivers seat thanks in large part to the voters appreciation of their stalwart opposition to this sordid practice. <br> <br> ]]>

<![CDATA[Insurance companies are spending millions of dollars to keep health reform from passing. Why do you think insurance companies are fighting health care reform. Who will health care reform benefit? Who will be taken to task as a result of health care reform. I believe insurance companies see the writing on the wall if health care reform passes. They will no longer be able to raise rates at their discretion, will not be able to drop clients at their discretion, will have to insure those with pre-existing condition, will not be able to limit payments to doctors for treatments, decision will be between doctor and patients not doctor, insurance and patient, etc ect. Do you think that insurance companies are fighting health care reform for your benefit? The right wing conservatives have gotten so brain washed they have not tried to answer the questions I posed above. The bottom line. the only reason an insurance company would be concerned about health care reform is because how it will affect their profit margin, that is capitalism. The other aspect to capitalism is that as consumers we should demand the best products on the market. These products should not be monopolized by a few companies and that is what has happened for years. Insurance companies have been protect by anti-trust laws which have given them free reign to treat the consumer any which way they want. We the consumer have gotten so used to being mistreated by the insurance companies that now that we can be freed from their tyranny we think that is bad. The reason you the American citizen should be concerned about health care reform is because it protects you and your family. I argued that the Bush administration’s attacks on the Bill of Rights, egregious as they are, do indeed have their precedents in history. I never meant to defend Bush on this basis, but merely to give historical perspective. I stand by what I said. Bush, bad as he is, has not violated the Constitution any worse than Lyndon Johnson, Richard Nixon or Harry Truman, and not as badly as Woodrow Wilson, Franklin Roosevelt, or Abraham Lincoln. <br> <br> Nevertheless, Bush did swear an oath to uphold the Constitution, and he has shirked that duty considerably. We should not hold him to the standard of past American tyrants, but rather to the finest of America’s founding principles. It is useful, though perhaps depressing, to see the many ways in which president Bush has trashed the most noble and inspiring of all attempts to limit government through law, the Bill of Rights. Even as he advocates a new amendment to the Constitution to set national standards on marriage, the most important amendments already in place have each fallen prey to the ravages of his government. <br> <br> Amendment I <br> <br> Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances. <br> <br> George W. Bush has shown an outright hostility to freedom of speech. In the name of combating "indecency," the FCC under Bush has raised its punitive fines to outrageous new levels, wasted money on an "investigation" of Janet Jackson’s breast, and pressured Clear Channel to drop the Howard Stern Show. Bush has applied and maintained draconian restrictions on the press in Iraq, even forbidding the photography of flag-draped caskets returning home. <br> <br> Attacking the fundamental right of free political speech, he signed the horrendous Bipartisan Campaign Finance Reform bill, which severely restricts dissent. The law makes it a crime for non-profit advocacy groups simply to mutter the name of a national candidate within the last sixty days before a general election. There is no excuse for Congress making a law abridging the freedom of speech when the First Amendment says, "Congress shall make no law… abridging the freedom of speech." Some thought that the Supreme Court would gut the law’s worst provisions, which it did not. If Congress relied on another branch of the government to intervene and protect the public from its excesses, it is guilty of a major dereliction of duty. <br> <br> As a result of Bush’s policies, the government has even attacked freedom of assembly, creating "free speech zones" and keeping war protesters away when Bush appears on camera. At the outset of the Iraq War, Oakland police injured several war protesters by assaulting them with wooden bullets and concussion grenades, even as they ran away. Some have argued that the protesters, interfering with war commerce, got what they deserved, but the "collateral damage" suffered by the dockworkers probably disrupted the flow of trade that day more than the protests.1 <br> <br> One could feasibly list examples of how Bush has compromised the right of Americans to "petition the government for a redress of grievances," but the single following statement from Bush to Bob Woodward captures the president’s feelings about his responsibility to answer to the people: <br> <br> "I'm the commander, see. I do not need to explain why I say things. That's the interesting thing about being the president. Maybe somebody needs to explain to me why they say something, but I don't feel like I owe anybody an explanation." <br> <br> It’s a wonder that Bush would want to deny others freedom in their speech when he so frequently demonstrates such inspiring eloquence in his own. <br> <br> Amendment II <br> <br> A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed. <br> <br> Many have long argued that Republicans value the Second Amendment more than Democrats. So far, Bush’s policy has fallen in line with the Republican and NRA doctrine on gun control: the right to bear arms is an inalienable right, and instead of passing unconstitutional gun laws, the government should enforce more strictly the 20,000 unconstitutional laws already on the books. In effect, Republicans oppose government undermining the choices of Americans, but so long as government is in the business of doing so, its programs should be fully funded and carried out by Republicans with strict adherence to the letter of the law, resulting in punishments as severe as possible. <br> <br> Ashcroft’s Justice Department has indeed turned up the heat on enforcing unconstitutional gun laws, boasting: "Under the President’s Project Safe Neighborhoods program, federal gun crime prosecutions have increased by 68 percent over the last three years. Last year, the Department set a new record of charging 23 percent more individuals for violating federal firearms laws." The Bush administration has asked for a $95 million increase in spending on gun control programs for 2005. He has also expressed willingness to renew the Assault Weapons Ban. <br> <br> Moreover, although Bush signed the law passed by Congress that allowed airline pilots to carry guns on planes – one of the few security measures after 9/11 that might have actually prevented the terrorist attack – his administration initially refused to implement it. Bush acquiesced only after Congress and the Senate reconvened and voted, by a supermajority, to force Bush to put guns in the hands of pilots. <br> <br> In spite of what Republicans in the NRA and Democrats in the Violence Policy Center might say, Bush has hassled gun owners more than any recent president, and has shown only contempt for any moderation in the War on the Second Amendment. <br> <br> Amendment III <br> <br> No soldier shall, in time of peace be quartered in any house, without the consent of the owner, nor in time of war, but in a manner to be prescribed by law. <br> <br> The Third Amendment is always the toughest to discuss in its relevance to today. Just as we must recognize that the "well regulated militia" line in the Second Amendment referred to a citizen’s militia when it was written in the late 18th century, we must consider the Third Amendment in proper historical context. <br> <br> The American colonists had just fought a revolution against Britain, the world’s superpower that had imposed its will on much of the planet’s peoples. The Third Amendment was written in memory of the Quartering Act of 1765, which compelled American colonists not only to give up sovereignty within their own homes, but also to pay taxes to build housing for British soldiers. After winning the Revolution, the Founding Fathers wanted to prevent the new American government from coercing its people into providing for its imperial and colonial ambitions the way Britain had done. <br> <br> As the U.S. government levies taxes on Americans – and even on Iraqis – to pay its soldiers fighting for the global quasi-Trotskyite democratic revolution that the War on Terrorism has become, Americans should judge for themselves if the Bush administration has disgraced the spirit of the Third Amendment. The manner in which the U.S. military treats the houses of Iraqis has hardly been a manner "prescribed by law." We can only hope that the U.S. government does not take the final steps in defying the letter, as well as the spirit, of the Third Amendment, by giving new meaning to "bringing the soldiers home." <br> <br> Amendment IV <br> <br> The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. <br> <br> This one is a no-brainer. The Patriot Act's "Sneak and Peak" provision allows the feds to come into your home, search your residence, and leave without telling you for up to six months. It has expanded the government’s powers under the Federal Intelligence Surveillance Act to get warrants for wiretaps from special courts, not subject to the same oversight as typical courts. Another provision allowed the FBI to obtain library records from librarians, who had to keep their mouths shut about confrontations with officials. Within months of 9/11, law enforcers had visited nearly 10 percent of America’s libraries "seeking September 11-related information about patron reading habits."2 The Justice Department has resurrected COINTELPRO, a surveillance program that subverted groups and incited violence between political dissidents in the Vietnam era. The administration’s ultimate goal of "Total Information Awareness" flies in the face of any decent understanding of the Fourth Amendment. <br> <br> Under Clinton, the Fourth Amendment was already in serious trouble due to the War on Drugs and other domestic surveillance programs. It has gotten indescribably worse since the 1990s, when Aschroft complained that Clinton wanted "to hand Big Brother the keys to unlock our e-mail diaries, open our ATM records, read our medical records, or translate our international communications."3 If today’s Aschroft met his counterpart from the 1990s, he would probably say that his avatar’s warnings against Clinton’s policies were frightening "peace-loving people with phantoms of lost liberty" and that such anti-government paranoia only gives "ammunition to America’s enemies and pause to America’s friends." <br> <br> The Bush administration has no intention to allow the anachronistic Fourth Amendment to disrupt the War on Terrorism. This is a war for freedom, after all, and we cannot let trivial liberties get in the way. <br> <br> Amendment V <br> <br> No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation. <br> <br> Shortly after September 11, the Immigration and Naturalization Service and Justice Department detained more than a thousand individuals, whom Bush labeled as "terrorists" even after the Justice Department admitted the detainees had no connection to terrorism.4 In addition, at least dozens of Americans were detained without due process of law because of a phony "material witness" status.5 <br> <br> The Patriot Act has greatly expanded federal asset forfeiture powers, which allow the government to confiscate property without even accusing its owners of a crime. Those who "smuggle" their own money out of the country may now see it seized. The administration has worked to extend the despotic power of eminent domain, which allows the government to seize property for such unconstitutional purposes as federal production of interstate electrical lines. <br> <br> When the founders discussed "due process of law" they meant more than the arbitrary power of executive edict. The Fifth Amendment has fallen victim to numerous beatings over the years, but Bush and company rank among its all time worst enemies. <br> <br> Amendment VI <br> <br> In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense. <br> <br> Perhaps James Madison meant to write at the end of this sentence, "unless the president considers the accused an ‘enemy combatant.’" <br> <br> Guantanamo Bay is the clearest and most troubling example of accused criminals detained without any of the benefits of an impartial trial with the due process spelled out in the Sixth Amendment. They do not receive the rights of war prisoners, nor of criminal defendants, because they fall under the makeshift category of "enemy combatant." Of course, Bush does not "accuse" these prisoners of being "enemy combatants" – because then they would have the rights of the "accused." He simply asserts they are "enemy combatants," and that settles that. <br> <br> The assertion that Guantanamo is constitutional because it is located outside America is ludicrous and unsettling. It is ludicrous because the U.S. has jurisdiction there, and if the government can violate your liberties by moving you outside the country, the Bill of Rights is meaningless. It’s unsettling because it is an admission that the goings on in Guantanamo are even more oppressive than the run-of-the-mill Bill of Rights violations that Americans will tolerate at home. <br> <br> Bush has violated the Sixth Amendment in other ways, but Guantanamo typifies his attitude toward its basic principles. The Founding Fathers would probably have an impossible time believing Bush’s flagrant disrespect for the rights of the accused. Of course, the Founding Fathers would have probably been considered terrorists, and would likely find themselves detained as "enemy combatants" for all their un-American beliefs and subversive political activism. <br> <br> Amendment VII <br> <br> In suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise reexamined in any court of the United States, than according to the rules of the common law. <br> <br> The Seventh Amendment is often misunderstood. Written in the aftermath of the American Revolution, its purpose was not only to guarantee the rights of defendants in civil cases, but also the rights of plaintiffs – especially of plaintiffs suing government agents for violations of their rights. After seeing mock courts set up by King George III to protect his minions from any meaningful legal recourse, the colonists wanted to guarantee that Americans suing government officials would be guaranteed a trial by jury. <br> <br> The Bush administration has been frightening in the way it has nullified lawsuits against its actions. The Justice Department simply laughed at attempts of the ACLU to get lists of detained suspects through lawsuits in early 2002.6 Ellen Mariani’s lawsuit against the Bush administration, accusing it of foreknowledge of, and failure to act on, September 11, may seem to many like the material of a conspiracy theory, but we can be fairly sure that the question will never go to a jury. Quite recently, an ACLU legal challenge against the Patriot Act became news after being silenced for three weeks by the Patriot Act. <br> <br> Perhaps the reason for the inability of Americans to successfully sue administration officials in a trial by jury is that none of these transgressions of which the government is accused is a controversy in which the value at issue exceeds twenty dollars. <br> <br> Amendment VIII <br> <br> Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted. <br> <br> We have seen Martha Stewart sentenced to prison for claiming innocence of a victimless crime. We have seen Tommy Chong sentenced to jail time for manufacturing glassware into the politically incorrect shape of marijuana paraphernalia. We have seen Clear Channel fined by the FCC for about half a million dollars, all over Howard Stern’s performing the same radio material he’s done for years. <br> <br> These are only some high profile cases of Americans suffering excessive punishments for victimless activities. One low-profile example, which should be widely known, is Mohammed Hussein, the first "criminal" ever convicted under the Patriot Act. He was called a terrorist by the government and media, he lost his money transmitting business, and he received an eighteen-month prison sentence. What did he do to deserve this? What was his crime under the Patriot Act? He incorrectly filled out an application for a state business license.7 Of course, conservatives still argue that the Patriot Act has not been abused. <br> <br> For decades Americans have endured punishments that had no semblance of proportionality to their "crimes." Under the Bush administration, the Eighth Amendment has been circumvented as increasingly cruel punishments have become decreasingly unusual. <br> <br> Amendment IX <br> <br> The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people. <br> <br> When the Constitution and Bill of Rights were being considered for ratification, some Americans pointed out possible loose ends. The "Antifederalists" – who often preferred the term "Federalists," and resented their opponents for stealing the label – wanted to ensure that the federal government only exercise those powers mentioned in the Constitution and that it did not violate certain fundamental rights. The Antifederalists tended to favor the Bill of Rights, but they feared that the listing of specific rights would be used to rationalize violations of unlisted ones. The Ninth and Tenth Amendments were meant to hammer home the notion that the federal government was subservient to the people. <br> <br> George W. Bush has no conception of the inalienable, unenumerated rights of the American people. He has flouted the personal, intimate right to self-medication by closing down medical marijuana facilities. He has affronted the right to peaceful trade by establishing protectionist steel tariffs and imposing sanctions on other countries, most recently Syria. His administration has abrogated the right to travel with his no-fly list, which uses the pretext of fighting terrorism to prevent political dissidents and those with names similar to those of suspects from flying. On September 11, 2001, the federal government even impeded the right to emigrate by forbidding anyone from leaving the country. His Patriot Act made it a crime to carry significant amounts of cash on a plane. While the Bush administration assaults the liberties specifically spelled out in the Bill of Rights, it also punishes those who wish to relieve their pain from cancer, improve their lives with commerce, or quietly leave the country with their savings – all unwritten, essential rights that James Madison and Thomas Jefferson would be appalled to see so routinely eviscerated in America. <br> <br> As constitutional scholar Randy Barnett says, "The Ninth Amendment mandates that unenumerated rights be treated the same as those that are listed."8 Bush would probably agree wholeheartedly, as he trashes our enumerated and unenumerated rights equally. <br> <br> Amendment X <br> <br> The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people. <br> <br> The Tenth Amendment concludes the Bill of Rights with a demand that the federal government be restricted to activities authorized in the Constitution. The constitutional powers of the president, Congress, and the Supreme Court are highlighted in Articles I, II and III of the main body of the Constitution, and anything outside of this delegated authority is not the proper jurisdiction of the national government. For years conservatives rightly complained that Democrats advanced all sorts of federal programs that had no constitutional basis. <br> <br> Almost every government abuse I mention in this essay qualifies as a violation of the Tenth Amendment. In addition to these violations, Bush has sharply increased farm subsidies, signing a record $190 billion dollar farm bill, and severely distorting domestic and international markets. He signed into law the largest expansion of Medicare since its inception, looting present and future taxpayers of hundreds of billions and maybe more than a trillion dollars in one of most shameless giveaways to preferred voters and business interests in decades. Aside from giving prescription drugs away free he has unleashed plans to build national surveillance systems to monitor "prescription drug abuse." <br> <br> Bush has increased federal funding for education, welfare, foreign aid, local law enforcement, and "faith-based" initiatives, and he has developed programs to encourage marriages and to provide relationship counseling. Since Bush took office, the U.S. budget’s discretionary spending has increased about 28%. Through his "compassion conservatism," George W. Bush has perhaps done more to advance the American welfare state than any other president in American history. <br> <br> There is not a single aspect of Americans’ economic and personal lives that the modern federal government considers off limits. When it comes to providing the federal government with new powers and duties for which there exists no constitutional authority, President Bush ranks among the very few most ambitious presidents in American history. <br> <br> The Bill of Rights – RIP? <br> <br> The Bush administration has been utterly hostile to the entire Bill of Rights. I did not focus on it, but one can quickly realize that Bush has violated all the principles of the Bill of Rights in regard to the Iraq War alone. Iraqis have been censored, disarmed, occupied, searched, hassled, regulated by curfew, severely and arbitrarily beaten and punished, tortured, humiliated, and generally abused by a foreign government that respects no limits on its power and regards Iraqis as if they have no impermeable rights at all. This is not to say that Saddam respected anyone’s rights, but it speaks to the lunacy of the U.S. government brutally instituting a constitution abroad when it has no regard for the constitutional safeguards against any of its own actions. <br> <br> During wartime, the Bill of Rights and its corresponding liberties tend to suffer extraordinary abuse. Bush prides himself as a "war president," and so it should come as no surprise when he treats his foreign and domestic subjects accordingly. <br> <br> Although, as I’ve said before, some previous presidents may have been as bad or even worse, we must still have a clear understanding and appreciation for how much George Bush and the present government are undermining the principles that made America so special. The first Ten Amendments of the Constitution provide a blueprint for an incredibly free society. Perhaps Bush, who has a phobia against reading anything aside from what his advisors give him, should break with personal custom for at least half an hour and read the Bill of Rights. <br> <br> Bush was just a puppet.]]>

Bush will often assail my assertion that the Bush administration has done more to dismantle constitutional protections of our liberties than any president in modern memory. It seems that these people believe that until federal Storm Troopers knock down the doors of their homes and drag them off to the gulags, they have lost no freedoms. Nothing could be further from the truth. <br> <br> If history is any teacher, it instructs us in the incremental process that elitists use to implement their totalitarian agenda. The first step is to use an incessant, highly orchestrated propaganda. For all practical purposes, the major media in the United States is providing that propaganda. At the national level, there is hardly any investigative journalism going on. Instead, the national press corps has become little more than lazy lackeys for the White House. <br> <br> The second step is to lay the foundation for totalitarianism by passing legislation that may later be used against the citizenry. And that is exactly what the Bush administration has very successfully accomplished. It very adroitly succeeded where the Clinton administration failed. <br> <br> For example, most conservatives would be surprised to learn that the Patriot Act and Department of Homeland Security was the brainchild of one William Jefferson Clinton. However, a recalcitrant Republican Congress denied Clinton the opportunity to implement these plans. Of course, with the Republican, G.W. Bush, serving as President, that same Republican Congress was all too eager to pass these bills into law. <br> Whether or not individual Americans have been personally subjected to tyranny as a result of lost freedoms doesn't change the fact that they have already lost these freedoms. <br> <br> The third step is to demonize and marginalize anyone and everyone who opposes the government's plans and ambitions. Such opponents are characterized as "unpatriotic," "obstructionist," "uncompassionate," or even "ungodly." Once again, the Bush minions have very skillfully done just that. Anyone who dares to oppose or even question Bush must be regarded as enemies of America or even as enemies of God. <br> <br> Of course, the last step is to begin using the power and force of government to physically silence or remove those who are determined to require such treatment. And, as Germany's National Socialists proved, by the time this happens, there is no one around who is capable of coming to the assistance of such people. <br> <br> For those who are willing to objectively analyze Bush's actions and policies, the truth is clearly seen: this President has systematically put in place laws, policies, and bureaucracies that can, are, and will continue to strip the American citizenry of the constitutional protections of their liberties. <br> <br> Following are examples of freedoms which President Bush and his fellow Republicans in Congress have already expunged (as reported by the Associated Press): <br> <br> FREEDOM OF ASSOCIATION: Government may monitor religious and political institutions without suspecting criminal activity to assist terror investigations. <br> <br> FREEDOM OF INFORMATION: Government has closed once-public immigration hearings, has secretly detained hundreds of people without charges, and has encouraged bureaucrats to resist public records questions. <br> <br> FREEDOM OF SPEECH: Government may prosecute librarians or keepers of any other records if they tell anyone that the government subpoenaed information related to a terror investigation. <br> <br> RIGHT TO LEGAL REPRESENTATION: Government may monitor federal prison jailhouse conversations between attorneys and clients, and deny lawyers to Americans accused of crimes. <br> <br> FREEDOM FROM UNREASONABLE SEARCHES: Government may search and seize Americans' papers and effects without probable cause to assist terror investigation. <br> <br> RIGHT TO A SPEEDY AND PUBLIC TRIAL: Government may jail Americans indefinitely without a trial. <br> <br> RIGHT TO LIBERTY: Americans may be jailed without being charged or being able to confront witnesses against them. <br> That good citizens are compliant and unconcerned regarding G.W. Bush's propensity to trample constitutional freedoms bespeaks a great ignorance or a great apathy, or both. <br> <br> These rights have already been lost! <![CDATA[ <br> Naomi Klein <br> <br> Award-winning journalist and author of The Shock Doctrine <br> Posted: March 3, 2010 01:00 PM <br> <br> Chile's Socialist Rebar <br> <br> Ever since deregulation caused a worldwide economic meltdown in September '08 and everyone became a Keynesian again, it hasn't been easy to be a fanatical fan of the late economist Milton Friedman. So widely discredited is his brand of free-market fundamentalism that his followers have become increasingly desperate to claim ideological victories, however far-fetched. <br> <br> A particularly distasteful case in point. Just two days after Chile was struck by a devastating earthquake, Wall Street Journal columnist Bret Stephens informed his readers that Milton Friedman's "spirit was surely hovering protectively over Chile" because, "thanks largely to him, the country has endured a tragedy that elsewhere would have been an apocalypse.... It's not by chance that Chileans were living in houses of brick -- and Haitians in houses of straw -- when the wolf arrived to try to blow them down." <br> <br> According to Stephens, the radical free-market policies prescribed to Chilean dictator Augusto Pinochet by Milton Friedman and his infamous "Chicago Boys" are the reason Chile is a prosperous nation with "some of the world's strictest building codes." <br> <br> There is one rather large problem with this theory: Chile's modern seismic building code, drafted to resist earthquakes, was adopted in 1972. That year is enormously significant because it was one year before Pinochet seized power in a bloody U.S-backed coup. That means that if one person deserves credit for the law, it is not Friedman, or Pinochet, but Salvador Allende, Chile's democratically elected socialist President. (In truth many Chileans deserve credit, since the laws were a response to a history of quakes, and the first law was adopted in the 1930s). <br> <br> It does seem significant, however, that the law was enacted even in the midst of a crippling economic embargo ("make the economy scream" Richard Nixon famously growled after Allende won the 1970 elections). The code was later updated in the nineties, well after Pinochet and the Chicago Boys were finally out of power and democracy was restored. <br> <br> Little wonder: As Paul Krugman points out, Friedman was ambivalent about building codes, seeing them as yet another infringement on capitalist freedom. As for the argument that Friedmanite policies are the reason Chileans live in "houses of brick" instead of "straw," it's clear that Stephens knows nothing of pre-coup Chile. The Chile of the 1960s had the best health and education systems on the continent, as well as a vibrant industrial sector and rapidly expanding middle class. Chileans believed in their state, which is why they elected Allende to take the project even further. <br> <br> After the coup and the death of Allende, Pinochet and his Chicago Boys did their best to dismantle Chile's public sphere, auctioning off state enterprises and slashing financial and trade regulations. Enormous wealth was created in this period but at a terrible cost: by the early eighties, Pinochet's Friedman-prescribed policies had caused rapid de-industrialization, a ten-fold increase in unemployment and an explosion of distinctly unstable shantytowns. They also led to a crisis of corruption and debt so severe that, in 1982, Pinochet was forced to fire his key Chicago Boy advisors and nationalize several of the large deregulated financial institutions. (Sound familiar?) <br> <br> Fortunately, the Chicago Boys did not manage to undo everything Allende accomplished. The National copper company, Codelco, remained in state hands, pumping wealth into public coffers and preventing the Chicago Boys from tanking Chile's economy completely. <![CDATA[CBS News has learned the FBI is investigating a little-known not-for-profit organization called Commonwealth Research Institute. It's located, like a lot of Rep. John Murtha's, D-Pa., pet projects, in his hometown, Johnstown, Pa. <br> <br> Commonwealth gets the same benefits as the Salvation Army or any other charity: It doesn't have to pay taxes. But its line of work may be surprising. It's a defense contractor. "It certainly raises a question," says Dean Zerbe, a former top Senate investigator. He questions Commonwealth's tax exempt status, saying it seems to do business just like any for-profit defense contractor. <br> <br> "There’s a lot of tests to being a charity, and just saying, ‘Well I’m doing research paid for by the government," said Zerbe, " - if that were the case, I would have 10,000 companies that would tomorrow be a charity." If Commonwealth were not a charity, it could owe roughly one-third of its profits in taxes. That could add up to millions, on more than $45 million dollars in government contracts. But it pays nothing. <br> <br> Documents show when Commonwealth was formed, company officials touted their connections to "the local Congressman" Murtha. <br> <br> According to a letter from the IRS to Commonwealth dated August 1, 2000, the agency questioned the officials on their application for charitable status. "(M)erely because an organization conducts research does not mean it will qualify for exempt status," wrote the IRS official. <br> <br> The IRS also noted, "Research results must be made available to the interested public within a reasonably short time after completion of the project." The IRS concluded, "We do not believe the information provided thus far clearly distinguishes you from a commercial research company which makes its services available to the general marketplace." <br> <br> Commonwealth officials responded in a Dec. 3, 2000 letter saying they anticipated their research would be for the "Department of Defense, Justice Department, National Science Foundation or the National Institute of Health (sic)." Commonwealth officials told the IRS that they may have some classified work but that only, "some small portion (10-20 percent) of the work completed will be restricted [from publication] for good reason." <br> <br> It was partly on that basis that the IRS ultimately granted Commonwealth charitable status. <br> <br> But nine years later, Commonwealth has apparently not published a single word of its government-backed research. Murtha's hometown, far from Washington, is an unlikely hub for defense contractors like Commonwealth. But they're in western Pennsylvania because it's Murtha's town, and as chairman of the Defense Appropriations Subcommittee, he has influence over which companies receive billions of tax dollars. <br> <br> Commonwealth Research gets all of its funding from government contracts. As for what taxpayers get in return, that’s hard to say. Commonwealth doesn’t have a website and wouldn’t tell CBS News how many employees work there or how they have spent millions of tax dollars. <br> <br> CBS News went to the address listed on Commonwealth’s tax records looking for the offices. But a security guard stopped us and our camera crew, saying, "Don’t, don’t photograph, I’m gonna ask you to get in your car and leave." A Commonwealth spokesman declined an interview and told CBS News they have "a track record of providing significant value" to the military and that "all" of their work, including a government contract under investigation worth up to $45 million dollars ... is "classified." The Act was amended by the 72nd Legislature transferring responsibility to the Texas Veterinary Medical Diagnostic Laboratory from the Texas Agricultural Experiment Station. Must qualify under the National Poultry Improvement Plan or, <br> <br> 2. Have a monitoring and testing program for breeder birds which is equivalent to the required program as approved by the Texas Veterinary Medical Diagnostic Laboratory Pullorum-Typhoid Office, or, <br> <br> 3. Have an official Pullorum-Typhoid test on individual birds conducted by Texas Veterinary Medical Diagnostic Laboratory testing Agent, or an approved accredited veterinarian. <br> <br> The owner must be issued a testing report or a flock certificate ($25.00 fee) depending upon the owner's needs or request is a premise with chickens only is tested negative. <br> <br> FLOCK TEST <br> <br> 1. All birds must be at least 16 weeks of age or nearing sexual maturity. <br> <br> 2. All birds must be tested (except waterfowl or pigeons) to qualify a premise. <br> <br> 3. Turkeys, pea fowl and pheasants require blood samples to be collected, and then submitted for testing in a TVMDL laboratory. <br> <br> POSITIVE "PLATE" REACTOR BIRDS <br> <br> 1. Flock owner will be issued a hold order for their premise and birds. <br> 2. Up to five (5) wing banded birds will be delivered to a TVMDL laboratory for culturing purposes. <br> <br> 3. Flocks negative for S.pullorum - S.gallinarium (Pullorum-Typhoid) upon culture, will be declared clean and issued a 12 month valid flock test or certificate report. <br> <br> 4. Flocks positive for S.pullorum - S.gallinarium (Pullorum-Typhoid) upon culture, will be placed under a Texas Animal Health Commission quarantine. All movement of poultry and poultry products (baby birds and hatching eggs) must cease. No poultry may leave the premise while under quarantine. <br> <br> QUARANTINE RELEASE <br> <br> 1. Flock must receive 2 consecutive negative tests at 21 day intervals (minimum) from the date of the positive test, or <br> <br> 2. Dispose of all birds and products, clean and disinfect premise and remain free of all poultry for 90 days. The strategy was detailed in a confidential party fundraising presentation, obtained by POLITICO, which also outlines how “ego-driven” wealthy donors can be tapped with offers of access and “tchochkes.” <br> <br> The presentation was delivered by RNC Finance Director Rob Bickhart to top donors and fundraisers at a party retreat in Boca Grande, Florida on February 18, a source at the gathering said. In neat PowerPoint pages, it lifts the curtain on the often-cynical terms of political marketing, displaying an air of disdain for the party’s donors that is usually confined to the barroom conversations of political operatives. <br> <br> The presentation explains the Republican fundraising in simple terms. <br> <br> "What can you sell when you do not have the White House, the House, or the Senate...?" it asks. <br> <br> The answer: "Save the country from trending toward Socialism!” <br> <br> Manipulating donors with crude caricatures and playing on their fears is hardly unique to Republicans or to the RNC – Democrats raised millions off George W. Bush in similar terms – but rarely is it practiced in such cartoonish terms. One page, headed “The Evil Empire,” pictures Obama as the Joker from Batman, while House Speaker Nancy Pelosi and Senate Majority Leaders Harry Reid are depicted as Cruella DeVille and Scooby Doo, respectively. The document, which two Republican sources said was prepared by the party’s finance staff, comes as Chairman Michael Steele struggles to retain the trust and allegiance of major donors, who can give as much as $30,400 a year to the party. <br> <br> Under Steele, the RNC has shifted toward a reliance on small donors, but the document reveals extensive, confidential details of the strategy for luring wealthy checkwriters, which range from luxury retreats in California wine country to tickets to a professional fight in Las Vegas. The 72-page document was provided to POLITICO by a Democrat, who said a hard copy had been left in the hotel hosting the $2,500-a-head retreat, the Gasparilla Inn & Club. Sources at the event said the presentation was delivered by Bickhart and by the RNC Finance Chairman, Peter Terpeluk, a former ambassador to Luxembourg under President George W. Bush. <br> <br> The RNC reacted with alarm to a question about it Wednesday, emailing major donors to warn them of a reporter’s question, and distancing Steele from its contents. “The document was used for a fundraising presentation Chairman Steele did not attend, nor had he seen the document,” RNC Communications Director Doug Heye said in an email. “Fundraising documents are often controversial. “Obviously, the Chairman disagrees with the language and finds the use of such imagery to be unacceptable. It will not be used by the Republican National Committee – in any capacity – in the future,” Heye said. <br> <br> The most unusual section of the presentation is a set of six slides headed “RNC Marketing 101.” The presentation divides fundraising into two traditional categories, direct marketing and major donors, and lays out the details of how to approach each group. The small donors who are the targets of direct marketing are described under the heading “Visceral Giving.” Their motivations are listed as “fear;” “Extreme negative feelings toward existing Administration;” and “Reactionary.” <br> <br> Major donors, by contrast, are treated in a column headed “Calculated Giving.” <br> <br> Their motivations include: “Peer to Peer Pressure”; “access”; and “Ego-Driven.” <br> <br> The slide also allows that donors may have more honorable motives, including “Patriotic Duty.” <br> <br> A major Republican donor described the state of the RNC’s relationship with major donors as “disastrous,” with veteran givers beginning to abandon the committee, which is becoming increasingly reliant on small donors. The party’s average contribution in 2009, according to the document, was just $40, and the shift toward a financial reliance on the grassroots may help explain Steele’s increasingly strident tone toward the Obama Administration. <br> <br> While the crude portrayal of Obama may be - as Steele ‘s spokesman put it - “unacceptable,” other elements of the presentation may be of equal interest to close political observers. The RNC plans to raise $8.6 million from major donors alone in 2010, less than 10% of its total 2009 fundraising take, which was primarily from small donors." <br> <br> The center of that plan is an extensive, and colorful, schedule of events. Along with traditional fundraisers with conservative luminaries including Weekly Standard Editor Bill Kristol and former presidential candidate Steve Forbes, the party plans to raise $80,000 for a trip to London to meet David Cameron, the British Conservative Party leader, on September 17.
