Prior to my son putting Coach Donnell on the cell phone to me (24 hours after the incident had happened), Coach had not even bothered to report it to the school administration. Funny enough, after I shared with Coach that I would be pursuing the issue outside of the school- I was contacted by the police before 30 minutes had passed. The call to law enforcement appears as if it was made as quick attempt to cover the coaches negligence up until then. (did not witness it) I also know how and when the investigations took place. It was handled properly! The police actually contacted your daughter in reference to the incident “not the other way around” like she stated on the news. The principal interviewed a lot of students that day and did not find the same information that your grandson provided. The principal contacted police to further investigate the allegation, so nothing was missed. Also, in reference to BISD Facebook page: I don’t know anything about that. Yes the principal DID report this to the police as soon as Christine indicated that she would escalate the situation. The police told Christine that they were informed by BISD representatives that an investigation carried out by school personnel had determined that the incident DID NOT OCCUR and that the could take no further action, referring her instead to the municipal court. Yes, school officials did report the incident after pressure and also after the coaches failure to report it after its occurrence as apparently required by the Texas Education Code. As far as your suggestion that Joe be moved to North Hills, are you indicating that BISD is doing a better job there or simply supporting a more more ethnically homogeneous environment, and if so, is it BISD policy to promote that? AGAIN BISD should open up. Why did you close the discussion section on your Facebook page after deleting Christine's request for help and information? I appreciate the complex environment school administrators must deal with on a day to day basis, yet, your current policy to minimize, delay and redirect is bound to backfire. Sooner or later BISD must and will deal with these issues in an effective manner. It would behoove the BISD and other school districts to embrace this opportunity to deal with these issues instead of continuing to dodge the issue. Parents are not told what happens to other students in reference to discipline of other students. I don't agree with it, but that's how most schools handle it. I think it would help knowing how a situation was handled. In this situation school officials asked the police department to investigate this situation because of several reasons: severity of allegations, where it happened, and because of what other students said in reference to this situation. The principal contacted the police before your own family did, so great job principals! Like I said there is way more to the story than you even know, and it is being handled correctly. When I was in school, 15 years ago-"depantsing" was common and quite funny to all but the victim, but also came with a one week suspension. Also, please encourage your son to do the right thing by talking to you and you talking to the administration at the school (Susan Taylor and Rod Bailey at Haltom Middle School and Mike Shabay of Birdville Independent School District). Other Concerned Parents- please voice your concern to Susan Taylor and Rod Bailey at Haltom Middle School and Mike Shabay of Birdville Independent School District. The incident: My son was assaulted by a known bully at Haltom Middle School. The kid intentionally rubbed his genitals on my sons rear end in the shower and said "if you are not out of my way in 10 seconds I will hump you as hard as I can." My son reported this immediately to Coach Donnell. Coach ignored my son's complaint. He did not report it to anyone in administration, nor did he contact me and inform me of what happened. After I brought attention to the matter, the next day, Coach Donnell finally decided to report the incident to the Assistant Principal (Rod Bailey). Again, Mr. Bailey did not contact me and inform me of what happened to my son. After pressing charges with the Haltom City Police and still not hearing anything from the school (my son had kept me informed of what was happening) I pursued an Administrator (Mike Shabay) at BISD to file a formal complaint against the school administration for not contacting me in regards to incidents of my child as well as ignoring numerous prior complaints against the assailant. He discouraged me from filing my complaint altogether, then when I refused asked me to wait until after Spring Break to file the complaint- waiting would have made my complaint null and void because district policy states that complaint must be filed within 15 calendar days of the incident. To date, the school denies anything happened. The assailant is back at school in the showers with our children (Mike Shabay said he could not segregate the child from the showers because he is a "minority student and that would have Channel 5 News all over the school district.") And the school has decidedly interfered with the Police Department forcing me to go directly to the Haltom City Municipal court to proceed with charges. Please help me in this cause. The only outcome I want is for the bully to have serious consequences for his continued serious actions and for Haltom Middle School and BISD to own up to accountability- I want them to do the right thing when complaints are filed. I want them to follow through with disciplinary action and I want them to communicate with parents when reason for concern happens at their schools. <![CDATA[As a public service announcement they don't want you to know!: You have the right to appeal the Civil ticket issued by the City of Arlington (and its corporate cronies) for allegedly running a red light in Arlington, after your first appeal for the administrative hearing. Be sure to appeal this bullshit hearing, where you will undoubtedly be found guilty. Even if you are considered guilty, you have the right after that for 31 days to form an appeal to a Municipal Court and see a real, elected judge, not an appointed official who's sole job is to deem you guilty. You have the right from then on to appeal continuously until you could possibly take the issue to the supreme court, where they would likely uphold your rights and overturn the "legality" of these lights. You have the right Constitutionally to a trial by your peers, do not let them take away that right! Force the appeals and the system will be clogged! You have the rights! Please use them! You also have the right to request an Engineering Evaluation, and to have access to that information for each light for your defense! BUSINESS AS USUAL, AND YOU CAN TOO!: If you wish to change things from "Business as Usual" in Arlington, please get the minutes from the 9/25/2007 meeting and find out who approved the cameras in the first place. It is obvious how they set it up that it is a fundraising-taxing program with no intention of creating a safer driving environment. Studies show (sorry that I am lacking the citation) that if there was only 1 second of total red, meaning the intersection is "cleared" allowing anyone who accidentally or purposefully ran the light to continue, that the rate of accidents drops dramatically. In addition, many of the contracts for camera lights require the times of the yellow lights to be reduced to just above the bare minimum for yellows. Is that safe?! Obviously not to anyone other than our leaders. Another thing that might surprise you is that the light legally never has to turn green! There is no minimum time allotment by the Texas Department of Public Safety for a green light. If you will note the length of the greens is often reduced for these lights as compared to adjacent streets, and yellows are reduced to cause more tickets to be generated. It is a scam, please drive safely! ...And er.. stop on yellow? I think not. Please make multiple requests for Engineering Evaluations on these lights, be sure you were given adequate time to go through the light! Trust me, you aren't and taking this evidence to an actual court will expose their fraud. ------------------------------- Here is the entire City of Arlington Ordinance with regards to camera traffic light enforcement. Obtained 2/24/2010 ARTICLE IX AUTOMATED RED LIGHT ENFORCEMENT Section 9.01 Definitions In this article: "Department" shall mean the Police Department of the City of Arlington, Texas. “Intersection” shall mean the place or area where two (2) or more streets intersect. "Owner" shall mean the owner of a motor vehicle as shown on the motor vehicle registration records of the Texas Department of Transportation or the analogous department or agency of another state or country. The term "owner" includes (i) a lessee of a motor vehicle under a lease of six (6) months or more or (ii) the lessee of a motor vehicle rented or leased from a motor vehicle rental or leasing company, but does not include the motor vehicle rental or leasing company itself. "Photographic traffic monitoring system" shall mean a system that: (1) consists of a camera and vehicle sensor installed to work in conjunction with an electrically operated traffic control signal; and (2) is capable of producing at least two (2) recorded images that depict the license plate attached to the rear of a motor vehicle that is not operated in compliance with the instructions of the traffic control signal. "Recorded image" shall mean an image recorded by a photographic traffic monitoring system that depicts the front or rear of a motor vehicle and is automatically recorded on a photograph or digital image. (Amend Ord 07-070, 9/25/07) "System location" shall mean the approach to an intersection toward which a photographic traffic monitoring system is directed and in operation. "Traffic control signal" shall mean a traffic control device that displays alternating red, amber and green lights that directs traffic when to stop at or proceed through an intersection. Section 9.02 Imposition of Civil Penalty for Creating Dangerous Intersections A. The City Council finds and determines that a vehicle that proceeds into an intersection when the traffic control signal for that vehicle's direction of travel is emitting a steady red signal damages the public by endangering vehicle operators and pedestrians alike, by decreasing the efficiency of traffic control and traffic flow efforts, and by increasing the number of serious accidents to which public safety agencies must respond at the expense of the taxpayers. B. The owner of a motor vehicle is liable for a civil penalty if the vehicle proceeds into an intersection at a system location when the traffic control signal for that vehicle's direction of travel is emitting a steady red signal. C. The civil penalty for which the owner is liable is seventy-five dollars ($75.00). (Amend Ord 07-070, 9/25/07) D. An owner who fails to timely pay the civil penalty shall be subject to a late payment fee of twenty-five dollars ($25.00). Section 9.03 Enforcement; Procedures A. The Department is responsible for the enforcement and administration of this article, including retention of hearing records. (Amend Ord 07-070, 9/25/07) B. In order to impose a civil penalty under this article, the Department shall mail a notice of violation to the owner of the motor vehicle liable for the civil penalty not later than the 30th day after the date the violation is alleged to have occurred to: 1. The owner's address as shown on the registration records of the Texas Department of Transportation; or 2. If the vehicle is registered in another state or country, the owner's address as shown on the motor vehicle registration records of the department or agency of the other state or country analogous to the Texas Department of Transportation. C. A notice of violation issued under this article shall contain the following: 1. A description of the violation alleged. 2. The location of the intersection where the violation occurred. 3. The date and time of the violation. 4. The name and address of the owner of the vehicle involved in the violation. 5. The registration number displayed on the license plate of the vehicle involved in the violation. 6. A copy of a recorded image of the vehicle involved in the violation limited solely to a depiction of the area of the registration number displayed on the license plate of the vehicle involved in the violation. 7. The amount of the civil penalty to be imposed for the violation. 8. The number of days that the person has in which to pay or contest the civil penalty. 9. A statement that the owner of the vehicle in the notice of the violation may elect to pay the civil penalty by mail sent to a specified address instead of appearing at the time of the administrative hearing. 10. A statement that a recorded image is evidence in a proceeding for the imposition of a civil penalty. 11. Information that informs the person named in the notice of violation: a. of the person's right to contest the imposition of the civil penalty against the person in an administrative adjudication; b. of the manner and time in which imposition of the civil penalty may be contested; c. that failure to pay the civil penalty or to contest liability in a timely manner is an admission of liability and a waiver of the owner’s right to appeal the imposition of a civil penalty, and that failure to appear at an administrative adjudication hearing after having requested a hearing is an admission of liability; and d. that failure to pay the civil penalty within the time allowed shall result in the imposition of a late-payment fee of twenty-five dollars ($25.00). 12. A statement that, if at the time and place of the violation the vehicle was being operated by a person other than the owner, if the owner is a natural person, the owner may transfer liability for the violation to the person who was operating the vehicle at that time and place if the owner submits to the City by affidavit, on a form provided by the City, or under oath at an administrative adjudication hearing the name and current address of the person: a. operating the vehicle at the time and place of the violation; b. who was the lessee of the vehicle at the time of the violation, if the vehicle was rented or leased from a person in the business of renting or leasing motor vehicles at that time; or c. who was the subsequent owner of the motor vehicle, if ownership of the vehicle was transferred by the owner before the time of the violation. (Amend Ord 07-070, 9/25/07) Section 9.04 Administrative Adjudication Hearing A. A person who receives a notice of violation under this article may contest the imposition of the civil penalty by filing a written request for an administrative adjudication hearing. The request for a hearing must be filed on or before the date specified in the notice of violation, which may not be earlier than the 30th day after the notice of violation was mailed. Upon receipt of a timely request, the Department shall notify the person of the date and time of the hearing, which will be within 30 calendar days after the date the request is received. B. In an administrative adjudication hearing, the issues must be proven by a preponderance of the evidence. The administrative adjudication hearing shall be held before a hearing officer appointed by City Council. C. The reliability of the photographic traffic signal enforcement system used to produce the recorded image of the motor vehicle involved in the violation may be attested to by affidavit of an officer or employee of the City. D. An affidavit of an officer or employee of the City or entity that alleges a violation based on inspection of the applicable recorded image is: 1. admissible in the administrative adjudication hearing and in appeal under Section 9.04(N); and 2. evidence of the facts contained in the affidavit. E. At the conclusion of the administrative adjudication hearing, the hearing officer shall enter a finding of liability or of no liability for the civil penalty. The finding must be in writing and be signed and dated by the hearing officer. F. A finding of liability for a civil penalty must specify the amount of the civil penalty for which the person is liable. If the hearing officer enters a finding of no liability, a civil penalty for the violation may not be imposed against the person. G. Failure to pay a civil penalty or to contest liability in a timely manner is an admission of liability for the full amount of the civil penalty stated in the notice of violation and constitutes a waiver of the right to appeal under Section 9.04(N). H. Failure to appear at an administrative adjudication hearing after having requested a hearing is an admission of liability for the full amount of the civil penalty stated in the notice of violation and constitutes a waiver of the right to appeal under Section 9.04(N). I. The civil penalty shall not be assessed if: 1. after a hearing, the hearing officer enters a finding of no liability; or 2. within the time prescribed in the notice of violation, the person against whom the civil penalty is to be assessed submits the proof described in Section 9.03(C)(12). J. A person who is found liable for a civil penalty after an administrative adjudication hearing shall pay the civil penalty and costs within thirty (30) calendar days of the hearing. K. It shall be an affirmative defense to liability under this article, to be proven by a preponderance of the evidence, that: 1. the traffic-control signal was not in proper position and sufficiently legible to an ordinarily observant person; 2. the operator of the motor vehicle was acting in compliance with the lawful order or direction of a police officer; 3. the operator of the motor vehicle violated the instructions of the traffic-control signal so as to yield the right-of-way to an immediately approaching authorized emergency vehicle; 4. the motor vehicle was being operated as an authorized emergency vehicle under Chapter 546 of the Texas Transportation Code and that the operator was acting in compliance with that chapter; 5. the motor vehicle was a stolen vehicle and being operated by a person other than the owner of the vehicle without the effective consent of the owner; 6. the license plate depicted in the recorded image of the violation was a stolen plate and being displayed on a motor vehicle other than the motor vehicle for which the plate had been issued; 7. the owner of the vehicle is a natural person, the vehicle was being operated by a person other than the owner of the vehicle, and the owner submits to the City by affidavit, on a form provided by the City, or under oath at an administrative adjudication hearing the name and current address of the person operating the vehicle at the time and place of the violation; or 8. the presence of ice, snow, unusual amounts of rain or other unusually hazardous road conditions existed that would make compliance with this article more dangerous under the circumstances than non-compliance. L. To demonstrate that at the time of the violation the motor vehicle was a stolen vehicle or the license plate displayed on the motor vehicle was a stolen plate, the owner must submit proof acceptable to the hearing officer that the theft of the vehicle or license plate had been timely reported to the appropriate law enforcement agency. M. Notwithstanding anything in this article to the contrary, a person who fails to pay the amount of a civil penalty or to contest liability in a timely manner is entitled to an administrative adjudication hearing on the violation if: 1. the person files an affidavit with the hearing officer stating the date on which the person received the notice of violation that was mailed to the person; and 2. within the same period required by Section 9.04(A) for a hearing to be timely requested but measured from the date the mailed notice was received as stated in the affidavit filed under Subsection (1), the person requests an administrative adjudication hearing. N. A person who is found liable after an administrative adjudication hearing may appeal that finding of liability to the Municipal Court by filing a petition of appeal with the clerk of the Municipal Court. The petition of appeal must be filed before the 31st day after the date on which the administrative adjudication hearing officer entered the finding of liability. O. An appeal stays enforcement and collection of the civil penalty imposed against the owner of the motor vehicle. The owner shall file a notarized statement of personal financial obligation to perfect the owner’s appeal. P. An appeal shall be determined by the Municipal Court by trial de novo. The trial de novo is an administrative hearing before a Municipal Court judge without a right to a jury trial. (Amend Ord 07-070, 9/25/07) Section 9.05 Effect of Liability; Exclusion of Civil Remedy; Enforcement A. The imposition of a civil penalty under this article is not a conviction and may not be considered a conviction for any purpose. B. The Department may not impose a civil penalty under this article on the owner of a motor vehicle if the operator of the vehicle was arrested or was issued a citation and notice to appear by a peace officer for a violation of Section 544.007(d) of the Texas Transportation Code recorded by the traffic-control signal monitoring system. C. The City Attorney is authorized to file suit to enforce collection of a civil penalty imposed under this article. Amend Ord 06-074, 8/8/06) ]]>
